Indiana uses OWI as its statutory term for drunk driving offenses. Understanding the penalty structure helps you see exactly what’s on the line when charges are filed in Hamilton County Superior Court.

BAC Thresholds & Implied Consent

The standard blood alcohol concentration (BAC) limit in Indiana is 0.08% for most drivers. Commercial drivers face a lower threshold of 0.04%, and drivers under 21 are subject to a 0.02% limit. Indiana’s implied consent law provides that anyone who operates a vehicle on Indiana roads is deemed to have consented to chemical testing. Refusing a breath or blood test results in an automatic one-year license suspension, separate from and in addition to any court-ordered suspension. That suspension is administrative, not criminal. It runs on its own track regardless of how the criminal case resolves.

Misdemeanor vs. Felony OWI Charges

Indiana OWI charges are tiered based on BAC and circumstances. A first offense with a BAC between 0.08% and 0.14% is typically a Class C misdemeanor, carrying up to 60 days in jail and fines up to $500. If the BAC is 0.15% or higher, or if the driving endangered another person, the charge rises to a Class A misdemeanor: up to one year in jail, fines up to $5,000, and a possible license suspension. A second offense carries mandatory minimums, at least five days in jail or 240 hours of community service, fines up to $10,000, and a license suspension of no less than 180 days. A third offense brings a minimum of 10 days in jail, a possible license suspension of up to 10 years, and potential habitual traffic violator designation.

Enhancement Factors

Certain circumstances can elevate an OWI charge or significantly increase the sentence. If a minor was in the vehicle, if the driver caused injury or death, or if BAC was 0.15% or higher, the charge may be elevated to a felony.
