Indiana Drug Charge Classifications & Penalties

Indiana classifies controlled substances into five schedules based on their potential for abuse and accepted medical use, with Schedule I carrying the highest penalties. Understanding where your charge falls on that scale is the first step in evaluating your defense options.

Possession Charges

Possession of cocaine, Schedule I or II narcotics, or methamphetamine is charged based on quantity. Under Indiana law, possession of under 5 grams is a Level 6 felony, carrying 6 months to 2½ years in prison and fines up to $10,000. From 5 to 10 grams, the charge rises to a Level 5 felony; 10 to 28 grams becomes a Level 4 felony; and 28 grams or more is a Level 3 felony, with a sentencing range of 3 to 16 years. Marijuana possession starts as a Class B misdemeanor, but prior convictions or higher quantities can elevate it to a Class A misdemeanor or felony.

Dealing Charges

Under Indiana Code 35-48-4-2, dealing in a controlled substance ranges from a Level 6 to a Level 2 felony depending on the substance, the quantity, and any aggravating circumstances. Enhancing factors, such as committing the offense in the presence of a child, near a school, or while in possession of a firearm, can elevate a charge by one full level.

Constructive Possession

Indiana recognizes both actual possession (drugs found on your person) and constructive possession (drugs found in a location under your control, such as a shared vehicle or home). Constructive possession charges rest on circumstantial evidence. Prosecutors must prove you both knew the drugs were present and had the intent and ability to control them, which can create room for challenge.

Pretrial Release

Under Hamilton County’s pretrial release schedule, certain serious drug offenses, including dealing in cocaine, narcotic drugs, or methamphetamine, may not qualify for automatic pretrial release. Bond and release conditions are determined at the initial hearing, which makes early legal representation particularly valuable.
