Penalties For Assault in Indiana
When facing an assault charge, you can face a wide range of penalties. Assault is defined as causing someone to fear imminent harm. If a reasonable person fears that they may be harmed by an action you take, then this would be considered assault.
However, assault is often combined with the crime of battery, which is the act of causing physical harm to a person. This can increase the penalties dramatically.
In the case of pure assault, the penalties range from a class C misdemeanor for simple assault, which carries a possible penalty of up to 60 days in jail and a $500 fine, to a class A misdemeanor for domestic assault which carries a fine of up to $1,000 and one year in jail.
When assault is combined with a charge of battery, the penalties range between a class 3 felony and a class 1 felony. The range depends on the severity of physical harm that is inflicted by the battery and whether the victim was family or not. A class 3 felony assault and battery charge carries up to a 16 year sentence and/or a $10,000 fine.
